ARUNODAYA'S ASSUMPTION OF RISK, RELEASE OF LIABILITY, TERMS & CONDITIONS, AND PRIVACY POLICY

PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS IMPORTANT LEGAL RIGHTS, INCLUDING YOUR RIGHT TO BRING CERTAIN CLAIMS AGAINST ARUNODAYA.

By booking, attending, participating in, or allowing a minor in my care to participate in any Arunodaya session, class, gathering, event, or related activity (collectively, the "Activity"), I acknowledge and agree to the following.

1. Voluntary Participation and Health

I understand that the Activity may include yoga, breathwork, mindful movement, meditation, outdoor exercise, walking, use of provided equipment, and related wellness practices. I choose to participate voluntarily.

I represent that I am physically and mentally able to participate safely. I understand that I am responsible for consulting a qualified healthcare professional before participating if I have, or believe I may have, any medical condition, injury, pregnancy-related concern, limitation, allergy, disability, or other condition that could affect my participation.

I will immediately stop participating and notify the instructor if I experience pain, dizziness, faintness, shortness of breath, chest discomfort, nausea, weakness, or any other concerning symptom.

Arunodaya does not provide medical advice, diagnosis, treatment, or medical care. Participation in the Activity is not a substitute for advice or care from a licensed healthcare professional.

2. Assumption of Risk

I understand that participation in the Activity involves inherent and other risks that may be known or unknown, foreseeable or unforeseeable. I voluntarily and knowingly assume all such risks.

These risks include, without limitation:

  • Muscle soreness, strains, sprains, fractures, falls, illness, and other physical injuries.

  • Uneven terrain, pavement, rocks, roots, mud, water, insects, plants, wildlife, and other natural or park conditions.

  • Heat, humidity, cold, rain, wind, lightning, changing weather, reduced visibility, and changing surface conditions.

  • Risks related to travel to, parking at, walking to, entering, exiting, and leaving the gathering location.

  • Risks associated with yoga mats, mat covers, and other equipment provided or used during the Activity.

  • Risks created by other park users, pedestrians, vehicles, bicycles, scooters, animals, or activities occurring in or near the park.

  • The actions, omissions, or conduct of other participants or third parties.

I accept full responsibility for my personal safety, hydration, physical condition, decisions, and belongings during and in connection with the Activity.

3. Food and Beverage Disclaimer

Arunodaya may offer optional, sealed, prepackaged complimentary items, which may include C2O Original Coconut Water and Sahale Snacks Pomegranate Vanilla Glazed Cashew Mix. These items are optional, may be declined, and are not prepared by Arunodaya.

I understand that food and beverages may contain, or be processed in facilities that handle, allergens and ingredients including, but not limited to, tree nuts, peanuts, milk, soy, wheat, sesame, and other allergens.

I am solely responsible for reviewing all product packaging, labels, ingredients, warnings, and allergen information before consuming any item. I will not consume an item if I have an allergy, sensitivity, dietary restriction, medical condition, or other concern that could make consumption unsafe.

Arunodaya does not guarantee that any food or beverage is allergen-free, gluten-free, vegan, or appropriate for any particular dietary need.

4. Equipment and Personal Property

Arunodaya may provide premium yoga mats and freshly laundered mat covers for participant use. I agree to use all equipment carefully, only as instructed, and to notify the instructor of any apparent damage or unsafe condition.

I am responsible for my personal property, including property left in a vehicle or at the Activity location. Arunodaya is not responsible for lost, stolen, damaged, or unattended personal property.

5. Weather, Changes, and Cancellation

Activities are generally held rain or shine. Arunodaya may delay, modify, relocate, shorten, or cancel an Activity when weather, park conditions, safety concerns, governmental direction, or other circumstances reasonably warrant doing so.

If Arunodaya cancels an Activity because conditions are determined to be unsafe, the booking guest may choose one of the following: reschedule, transfer the reservation to another guest, or receive a full refund.

This weather-cancellation option applies only when Arunodaya cancels the Activity. Participant cancellations, late arrivals, no-shows, and other booking changes are governed by Arunodaya's separate cancellation and booking policies published on its scheduling page.

6. Release of Liability

TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, I HEREBY RELEASE, WAIVE, DISCHARGE, COVENANT NOT TO SUE, AND HOLD HARMLESS ARUNODAYA; VISWATEJ ATTILI; AND THEIR RESPECTIVE OWNERS, INSTRUCTORS, CONTRACTORS, VOLUNTEERS, AGENTS, REPRESENTATIVES, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, THE "RELEASED PARTIES") FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, LIABILITIES, COSTS, OR EXPENSES ARISING OUT OF OR RELATED TO MY PARTICIPATION IN THE ACTIVITY.

THIS RELEASE INCLUDES CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY.

This release includes, without limitation, claims for personal injury, illness, death, property damage, or other loss arising from or related to:

  • My participation in the Activity.

  • Outdoor and park conditions.

  • Travel to or from, parking at, walking to, entering, exiting, or leaving the location.

  • The use of provided equipment.

  • The optional consumption of complimentary packaged food or beverages.

  • The acts or omissions of other participants or third parties.

THIS AGREEMENT DOES NOT RELEASE CLAIMS ARISING FROM GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR LIABILITY THAT CANNOT LEGALLY BE WAIVED UNDER APPLICABLE LAW.

7. Indemnification

To the fullest extent permitted by law, I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of my own negligent or intentional acts, my violation of park rules or this Agreement, or injury I cause to another participant or third party during the Activity. This indemnification obligation does not require me to indemnify a Released Party for that party's own gross negligence or willful misconduct.

8. Emergency Medical Care Authorization

In the event of an injury or medical emergency during the Activity, I authorize Arunodaya and its instructors to contact emergency medical services (such as 911) and to take reasonable steps to secure care for me or the minor in my care. I understand Arunodaya is not obligated to provide medical treatment itself and that I am responsible for any costs associated with emergency care, transport, or treatment.

9. Photo, Video, and Media Release

I grant Arunodaya permission to photograph or record me and/or the minor in my care during the Activity and to use such photographs, video, or likeness in marketing materials, social media, and its website, without compensation to me. If I do not wish to be photographed or recorded, I agree to notify the instructor in writing before the Activity begins, and Arunodaya will make reasonable efforts to honor that request.

10. City Park Use and Conduct

I understand that the Activity takes place in a public park and that Arunodaya operates subject to applicable City of Austin requirements and permits.

I agree to comply with posted park rules, all applicable laws, and reasonable instructions from the instructor. I will conduct myself respectfully and will not engage in conduct that creates a safety risk, disrupts the Activity, damages property, or interferes with other park users.

I understand that the Activity is independently operated by Arunodaya and is not sponsored, endorsed, or operated by the City of Austin.

11. Minors

If I book for, bring, or permit a participant under 18 years of age to attend, I represent and warrant that I am the participant's parent or legal guardian, or otherwise have legal authority to agree to this Agreement on the minor's behalf.

I agree to supervise the minor as appropriate, accept responsibility for the minor's participation and conduct, and agree to the terms of this Agreement both individually and on the minor's behalf, including the release, indemnification, and medical authorization provisions above.

12. Payment, Booking, and Refund Terms

Pricing is disclosed at the time of booking and is charged per person unless otherwise stated. Payment is processed through Arunodaya's third-party scheduling and payment provider (Acuity Scheduling, a division of Squarespace). Arunodaya is not responsible for errors, delays, or outages caused by that third-party platform.

Except where this Agreement provides for a refund, transfer, or reschedule due to Arunodaya's own cancellation of an Activity, all sales are final. Any additional cancellation, rescheduling, or refund terms are as stated on Arunodaya's scheduling page at the time of booking.

13. Intellectual Property

All content on Arunodaya's website and materials, including text, photographs, logos, and branding, is the property of Arunodaya and may not be copied, reproduced, or used without prior written permission.

14. No Warranties

The Activity is provided "as is." Arunodaya makes no warranties, express or implied, regarding results, fitness outcomes, or suitability of the Activity for any particular individual, except as expressly stated in this Agreement.

15. Governing Law and Venue

This Agreement is governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising out of or related to this Agreement or the Activity shall be brought exclusively in the state or federal courts located in Travis County, Texas, and I consent to the personal jurisdiction of those courts.

16. Electronic Signature and Agreement

I agree that checking the acceptance box, clicking "I agree," or otherwise indicating acceptance electronically constitutes my valid signature and acceptance of this Agreement, with the same legal effect as a handwritten signature.

17. Entire Agreement; Severability; No Waiver

This Agreement, together with any policies referenced on Arunodaya's scheduling page, constitutes the entire agreement between the parties regarding the Activity and supersedes any prior oral or written understandings. If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Arunodaya's failure to enforce any provision of this Agreement is not a waiver of its right to do so later.

18. Acknowledgment and Agreement

I confirm that I have read this entire Agreement, understand its terms, and have had the opportunity to ask questions before participating.

I understand that I am voluntarily giving up important legal rights, including the right to bring certain claims against the Released Parties for their ordinary negligence.

I agree that this Agreement is binding on me and, where applicable, on my spouse, family members, heirs, personal representatives, successors, and assigns.

ARUNODAYA PRIVACY POLICY

Arunodaya ("we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, share, and protect your personal information when you visit our website, book an Activity, or otherwise interact with us.

Information We Collect

  • Contact information: name, email address, phone number.

  • Booking information: appointment type, date, time, number of guests, and payment confirmation (payment itself is processed by our scheduling provider; we do not store full payment card details).

  • Communications: messages you send us through inquiry forms, email, or text.

  • Website usage data: such as pages visited, device type, and general location, collected automatically through standard website analytics or cookies, if enabled.

How We Use Your Information

We use the information we collect to:

  • Schedule, confirm, and manage your booking.

  • Communicate with you about your Activity, including reminders, weather updates, or schedule changes.

  • Respond to inquiries and provide customer support.

  • Send occasional marketing communications, such as new offerings or availability, if you have opted in.

  • Improve our website and services.

How We Share Your Information

We do not sell your personal information. We may share information with:

  • Acuity Scheduling / Squarespace, our booking and payment platform.

  • Email or SMS communication providers, to send confirmations, reminders, and updates.

  • Legal or governmental authorities, if required by law or to protect the safety of participants or staff.

Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, or as required by law.

Your Choices

You may request to access, correct, or delete your personal information, or opt out of marketing emails or text messages at any time, by contacting us using the information below. Text messages allow opt-out by replying STOP; emails include an unsubscribe link.

Children's Privacy

Our services are not directed to children, and we do not knowingly collect personal information directly from children under 13. Parents or guardians may submit booking information on behalf of a minor participant.

Changes to This Policy

We may update this Privacy Policy from time to time. The updated version will be posted on this page with a revised effective date.
